1 – Introduction
The general sales conditions given below (hereafter referred to as the “General Conditions”), govern the contractual relationship between any user of the site, fanastick.com (hereafter referred to as a “User” or “You”) and the commercial name fanastick.com belonging to the company FANASTICK, the head office of which is at Hameau de la source - 69270 SAINT ROMAIN and which is registered on the Lyon Business Register under number 507 803 310 (hereafter referred to as "fanastick.com").
These General Sales Conditions are the only ones applicable and replace all other conditions, unless prior specific and written exemption has been granted. fanastick.com may, from time to time, be forced to modify some of these 78* measures of its general conditions, and so they should be read again each time the fanastick.com site (hereafter referred to as the "Site") is visited. These modifications are opposable, from when they come on-line and cannot be applied to contracts drawn up beforehand. Each purchase on the Site is governed by the general conditions applicable on the date of the order. We consider that by validating your order, you unreservedly accept our general sales conditions after reading them.
By accessing the Site, you undertake to respect the General Conditions as well as the Conditions of Use mentioned there.
2- To place an order
There are three ways to place an order available to you:

3- Prices
The prices shown on the Site are in euros and include all taxes but exclude delivery costs. Delivery costs are shown to the User as he chooses his products and are invoiced at the end of the order, in addition to the price of the products chosen.
We reserve the right to change our prices at any time but we undertake to apply the rates in force shown on the Site at the time of your order.
4- Availability
You should note that we will honour your order in so far as stock is available. In the case where one of the products ordered is not available from stock, we will contact you by e-mail within 24 hours of the date of your order, in order to tell you so and indicate within what timeframe this product may, where necessary, be delivered to you.
5- Delivery methods
Products bought on the Site are delivered in Metropolitan France, French overseas departments and territories, and Europe. Your order will be delivered to the address you have given when placing your order.

This delivery option means you will receive your parcel within 48 hours by the postal service and Colissimo tracking service. Your placed order will be dealt with in 24 hours and dispatched by post.
fanastick.com does all it can to meet the delivery times given on the Site. Nevertheless, we cannot be held responsible for consequences due to a delay in delivery or the loss of a parcel, caused by a third party or by you, or due to an unforeseeable and insurmountable cause which constitutes a case of force majeure.
Where a parcel is not received within the timeframe given, an inquiry is made to the carrier and this can take several days (eg 21 days with the Post Office). During this period, no refund can be made nor can the goods be re-sent.
When you receive your order, we recommend that you check the goods delivered against your order and, where necessary, show on the delivery note, your reservations and any anomaly in your handwriting along with your signature.

Product returns can only be accepted if the products are in their original condition, in particular, in their original packaging, with accessories and instructions for use. Costs for returning the goods are the User’s responsibility.
Where non-conformity is established, fanastick.com will replace the product. It is possible there will be a 24 hour delay in delivery of your order. Indeed, for security reasons, all orders paid for by a bank card will be subject to verification by fanastick.com
You may be asked for additional information, in order to validate your purchase. Therefore, in order to avoid any delay, when placing your order please submit:
- an e-mail address which is paid for (such as AOL, WANADOO, NOOS, TISCALI...) or a professional e-mail address.
- a landline telephone number (place of work or residence) where you can be reached at any time of day.
We regret any inconvenience caused, however these measures prove our wish to protect our customers from any possible bank card fraud.
6- Tax Refund
A tax refund is possible for customers living abroad (outside the EC). To obtain such a refund, you must send us a photocopy of the invoice and proof of residence abroad.
Once the invoice has been seen by Customs, the User must send it to us together with bank details and then fanastick.com will carry out a tax refund by cheque.
For a VAT refund, a deduction of 3% will be applied to cover “administration costs”.

7- Secure payment
All payments carried out on fanastick.com are assessed and checked by SOGENACTIF from the Société Générale and Paypal. fanastick.com offers three payment methods: credit card (CB Eurocard, Visa or Mastercard), by Paypal account and by cheque.
For payment by credit card, the amount will be debited from the card when you place your order as long as prior authorisation for the debit from your account has been obtained from the relevant payment centres, without which your order cannot be processed. On-line credit card payment is carried out by the SSL “Secure Socket Layer” security system which encrypts your bank details while they are transmitted on the network.
For cheque payments, you simply need to send us your cheque made out to FANASTICK, together with your order summary to: fanastick.com Payments Centre, Hameau de la source - 69270 SAINT ROMAIN. On receipt of your cheque, your order will be dispatched.
8- Right of withdrawal. Satisfaction or refund
With fanastick.com, you have 7 full days under Article L 121-20 of the Consumer Code, to return the product to us if you are not satisfied. Within this period, you can return the product together with your invoice, at your expense.
We advise you to return the merchandise to us by recorded delivery or by registered mail and possibly take out insurance with the carrier for the market value of the products. This is required in the case of despoilment or loss of merchandise whilst in their care. In all cases, the cost of returning goods and the risks involved are the consumer’s responsibility.
Products will only be accepted if they are in brand new condition and are complete (accessories, instructions), and they must be returned in their original packaging. Any product which is damaged, or where the original packaging has been damaged beyond simply being opened, will not be refunded, or will be partially refunded according to the conditions shown below. If an incomplete or damaged item is sent back to fanastick.com, a deduction from its price will be applied after the After Sales Department has examined the goods. fanastick.com’s After Sales Service will provide written justification of this deduction to the customer.
The time limits mentioned above run from the day on which the order was received. This right of withdrawal carries no penalty, with the exception of transportation costs. In the case where assessment of the product falls within the context of the right to withdraw, fanastick.com will do everything possible to refund the User as soon as possible.
When a refund is made, the User will be refunded by bank transfer in the case of payment by bank card, or by cheque in the other instances.
9- Return
Any parcel(s) being returned should be sent to us by post (or by another carrier). Please note the postal costs are the customer’s responsibility.
10- Disputes and liability
This contract is subject to French law,fanastick.com cannot be held responsible for the agreed contract not being executed, firstly in cases of force majeure, specifically in the case of disruption or total or partial strike, in particular of the postal service and means of transport and communications, and secondly, in the case where the customer is at fault. We remind you that it is wise to save data contained in the products bought. fanastick.com cannot be held responsible for consequences resulting from incorrect use of the products sold on the Site
11- Comments, criticisms, communication
All opinions given by Users of fanastick.com are monitored and moderated by the marketing team. Where words break the law and are unethical (abusive publicity, defamatory words, insults, comments out of context etc) fanastick.com reserves the right to refuse or modify the opinion concerned.
12- Protection of personal data
As the information you send us is essential for administration and delivery of orders and issuing invoices, its absence means your order will be cancelled. By registering on the Site, you undertake to supply us with true and honest information about yourself. Communication of false information contravenes these general conditions as well as the conditions of use shown on the Site.
Under the law on “Information Technology and Freedom”, the handling of your details is subject to a declaration to the National Commission for Data Protection and Liberties. (CNIL). fanastick.com is authorised to take, handle and use information concerning you. This data is subject to information technology processing.
This activity is strictly regulated: the data file has been declared to the National Commission for Data Protection and Liberties. You have a permanent right to access and to rectify all data concerning you, in accordance with European texts and national laws in force (Article 34 of the law of 6th January 1978). At any time, you can apply to fanastick.com to find out what information is available to us about you. At any time, and on request, you can modify this data.
If you have accepted this option when registering on the Site, you will be sent promotional e-mails (electronic mails) offering you new products, exclusive offers and special deals.
